ORDER : The Court Made the following order :- The petitioner is figuring as second accused in S.C No.98 of 2005 on the file of the learned Chief Judicial Magistrate, Nagercoil. He did not appear on 05.04.2005. Hence, Non Bailable Warrant came to be issued.
2.The learned counsel appearing for the petitioner undertakes that the petitioner would personally appear on all future hearing dates without fail.
3.Recording the said undertaking, the petitioner is directed to appear before the jurisdictional Court on the next hearing date and apply for recalling the warrant. The Trial Court shall recall the warrant on the same day. Accordingly, this petition is allowed. If the said undertaking given by the petitioner is breached, this order would stand automatically cancelled.
