PRAYER: Criminal Original Petition is filed under Section 528 of BNSS Act, Tko Call for the records pertaining to the impugned charge sheet in impugned charge sheet in SC No.764/2025 on the file of the learned Subordinate Court, Valliyoor, Tirunelveli District and to Quash the same as illegal in so far as the petitioner is concerned and pass such further order other orders. ORDER

The present petition has been filed by Accused No.3 in S.C. No.764 of 2025 on the file of the learned Subordinate Court, Valliyoor, Tirunelveli District, seeking to quash the charge sheet, wherein he is charged with offences under Sections 147, 294(b), 323, 307, and 506(2) of the IPC.

2. A perusal of the charge sheet reveals that the petitioner, along with others, is alleged to have abused and attacked the defacto complainant.

3. According to the learned counsel appearing for the petitioner, a false version has been portrayed by the investigating agency, and no such incident has taken place.

4. Heard, the learned Counsels appearing on either side and perused the materials available on record.

5. A perusal of the charge sheet clearly reveals that the petitioner is alleged to have abused and attacked the de facto complainant. 2/4

6. In such circumstances, this Court does not find any legally sustainable ground for quashing the charge sheet, and there are no merits in the present petition.
