PRAYER: Petition filed under Article 226 of the Constitution of India, to issue a writ of mandamus directing the respondent No.4 to ensure the petitioner's right in light of the proceedings in Sa.Mu.Na.Ka.No.771/2023-9/Aa2, dated 29.05.2023 and permit the petitioner to conduct the Chitrai Festival of Arulmigu Melaperumal Thirukovil and its subsidiary temples 1) Arulmigu Sri Mariamman, 2) Sri Krishnan, 3) Sri Vinayagar and 4) Sri Kavadikal situated at Renga Servaikaranpatti, Natham Taluk, Dindigul District, to conduct the festival in the peaceful manner from 20.04.2025 to 24.04.2025. Heard Ms.S.Shunmathi Priya, learned counsel, for the petitioner.

From the perusal of the affidavit filed in support of the writ petition and the relief sought therein, the grievance of the petitioner appears to be that he is not being allowed to exercise his right as a Non-Hereditary Trustee in terms of the proceedings bearing Sa.Mu.Na.Ka.No. 771/2023-9/Aa2, dated 29.05.2023. Hence, the petitioner is seeking a writ of mandamus to direct the fourth respondent to protect his right under the said proceedings dated 29.05.2023, through which, he was appointed as a Non-

Hereditary Trustee of Arulmigu Melaperumal Thirukovil. Further, from the materials available on record, it does not appear that the petitioner has ever approached the fourth respondent seeking for such protection. In the circumstances, this Court is of the considered view that it would be appropriate for the petitioner to approach the fourth respondent at the first instance by submitting a representation instead of approaching this Court by filing the present writ petition.

In view of the above, this writ petition is disposed of by permitting the petitioner to submit a representation before the fourth respondent seeking the relief as sought in the present writ petition within a period of two days from today and in case if the petitioner submits any such representation, the fourth respondent is directed to take appropriate action thereon in accordance with law, on or before 21.04.2025.
