The petitioner herein seeks a direction to the respondents 1 and 2 to consider the petitioner's application dated 13.05.2022 and measure the subject property situated in S.No.71/8B1 with an extent of 1.5 cents.
2. According to the petitioner, the subject property is the ancestral property and patta for the said property stands in the name of the petitioner in patta No.6456. The petitioner submitted an application on 29.07.2022, seeking survey of the property. Though the official respondents fixed the date for survey of the property on 07.01.2023, the same could not be completed on the said date, on an objection raised by the fifth respondent. Hence, the petitioner has come before this Court seeking necessary protection. 2/5
3. Heard the learned counsel appearing for the petitioner, the learned Additional Government Pleader appearing for the respondents 1 and 2, the learned Government Advocate appearing for the respondents 3 and 4 and the learned counsel appearing for the fifth respondent.
4. The learned Additional Government Pleader appearing for the respondents 1 and 2 would submit that the application submitted by the petitioner will be considered in accordance with law.
5. In view of the same, without expressing any opinion on the merits of the matter, the first respondent is directed to consider the application submitted by the petitioner, dated 29.07.2022 and pass final orders on its own merits within a period of eight weeks from the date of receipt of a copy of this order, after issuing notice to the petitioner and the fifth respondent. 3/5
6. Accordingly, this Writ Petition stands disposed of. There shall be no order as to costs.
