.. Respondents Prayer: Writ Petition is filed under Article 226 of the Constitution of India, praying this court to issue a Writ of Mandamus forbearing the 1/6

respondents from demolishing the petitioner's tiled houses situated at Old Survey No.33/2, New Survey No.94/16 Thiruvalavayanallur Village, Vadipatti Taluk, Madurai District without following due process of law, and consequently direct the 2nd and 3rd respondent to measure the petitioner's property through District Surveyor after issuing due notice to the petitioner and fix the boundaries based on records.

ORDER

The petitioner is before this Court forbearing the respondent from demolishing the petitioner's house situated at Old Survey No.33/2, New Survey No.94/16 Thiruvalavayanallur Village, Vadipatti Taluk, Madurai District.

2. The petitioner claims to be the owner in possession of the said house and his grievance is that the respondents, without following due process of law, are attempting to demolish the house citing that the said house is constructed in the Government land.

3.Mr.P.Subbaraj, learned Special Government Pleader appearing for the respondents 1 to 3, on receiving instructions, submitted that the representation dated 21.01.2026 submitted by the petitioner will be considered on its own merits and appropriate orders will be passed in accordance with law within a period of six(6) weeks.

4.The said submission is taken on record.

5.The Writ Petition is disposed of directing the third respondent to consider the representation dated 21.01.2026 submitted by the 3/6

petitioner on its own merits and pass appropriate orders in accordance with law within a period of eight(8) weeks from the date of receipt of a copy of this order.

6. Till consideration of the said representation, the respondents are hereby restrained from taking any coercive steps for demolishing the subject house.

7. There shall be no orders as to Costs. Consequently, connected miscellaneous petition is closed.
