O R D E R

The order of rejection, dated 06.04.2018, passed by the second respondent, rejecting the claim of the petitioner for compassionate appointment, is under challenge in this writ petition.

2. The petitioner states that his father P.Chidamparam was working as Police Head Constable in Seevalaperi Police Station and died on 04.02.2011 while he was in service. He submitted application seeking compassionate appointment on 16.03.2018 and it was rejected by stating that one Mr.C.Velladurai, who is the brother of the petitioner, is working as Grade-II Police Constable. When any one of the legal heirs of the deceased is employed in Government Department on in Private Sector, then the family of the deceased employee is not eligible to avail the scheme of compassionate appointment.

3. In the present case, the application itself was filed after a lapse of seven years from the date of the death of the deceased employee. Further, the brother of the petitioner is employed as Grade-II Police Constable. Therefore, the family of the deceased employee is not entitled for appointment on compassionate grounds with reference to the terms and conditions of the compassionate appointment.

4. With the above observations, the writ petition is dismissed. No costs.
