ORDER : The Court made the following order :- The petitioner / Accused, who was arrested and remanded to judicial custody on 26.02.2026 for the offences punishable under Sections 103(1) r/w 311 of BNS, 2023 @ Section 103(1), 190, 191(2), 310(3), 311, 49 and 61(2) of BNS, 2023 in Crime No. 75 of 2026 on the file of the respondent police, seeks bail.

2. The case of the prosecution is that the petitioner and the deceased were relatives. On 19.02.2026, the petitioner and other accused were staying in a cottage and in a drunken stage, they have stated a quarrel with the deceased, out of which the accused tied the deceased in the cottage room and murdered him and looted 2 sovereigns of gold chain and 1 1⁄2 sovereigns of gold ring and escaped from the scene of occurrence. Hence the case.

3. The learned counsel appearing for the petitioner would submit that the petitioner is innocent and he was falsely implicated in this case and he has not committed any offence as alleged by the prosecution. He would further submit that he has been arrested and remanded to judicial 2/5

custody on 26.02.2026. Therefore, prayed to grant bail for the petitioner.

The learned Additional Public Prosecutor appearing for the respondent would submit that based on the complaint lodged by the daughter of the deceased, the case has been registered under Sections 103(1) r/w 311 of BNS, 2023 @ Section 103(1), 190, 191(2), 310(3), 311, 49 and 61(2) of BNS, 2023 in Crime No. 75 of 2026. He would further submit that the investigation is in initial stage and the offences are grave in nature and hence, he strongly opposed to grant bail to the petitioner.

5. This Court heard both sides and perused the materials available on record.

6. Considering the rival submissions made by the learned counsel on either side, nature of offence, and considering the fact that the investigation is in initial stage and taking into considering the gravity of offence, this Court is not inclined to grant bail to the petitioner at this stage.
