For Respondent : Mr.T.Senthilkumar, Additional Public Prosecutor PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :- For Anticipatory Bail in Crime No.1772/2020 on the file of the respondent police.
ORDER : The Court made the following order :- The petitioner/A2 who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 8(c) r/w 20(b)(ii)(B) and 25 of NDPS Act in Crime No.1772 of 2020 on the file of the respondent police, seeks anticipatory bail. 2.The case of the prosecution is that on 05.09.2020 at about 19.30 hours, based on the secret information, the respondent police took an inspection at Anumanthanpatti Bus Stand, at that time, a two-wheeler vehicle bearing Reg.No.TN-58-J-9263, Yamaha Cygnus-Z-Ray was driven by a person with a bag. On seeing the police, he fled away from the scene of occurrence by dropping the vehicle and the bag. The respondent police has seized 5 pockets, totally contains 2 kgs of Ganja from the bag. Hence the case.

4.It is seen from the records that the petitioner has only received the amount from the first accused and purchased the contraband. After seeing the police officials, he left the vehicle and flee away. That apart, the petitioner has already involved in two previous cases for similar offence. Therefore, the custodial interrogation of the petitioner is very much required in this case. 5.Taking note of the bad antecedents of the petitioner, this court is not inclined to grant anticipatory bail to the petitioner. Hence, this petition is dismissed.
