For Petitioners : Mr.K.Sivabalan For R-1 and R-2 : Mr.R.M.Anbunithi Additional Public Prosecutor O R D E R This petition has been filed to direct the II Additional Sessions Judge (PCR Act Cases) Tirunelveli, to accept the surrender of the petitioner and consider the bail application on the date of surrender in connection with Crime No.140 of 2021 on the file of the second respondent Police.

2. The petitioner is the accused No.11 in Crime No.140 of 2021 on the file of the second respondent for the offences punishable under Sections 147, 148, 294(b), 341, 323, 324, 427 and 506(ii) I.P.C r/w Section 4 of the Prohibition of Harassment of Women Act, 2002 and Sections 3(1)(r), 3(1)(a) and 3(2)(va) of SCH Caste and the SCH Tribes (Prevention of Atrocities) Amendment Act,2015 dated 27.06.2021.

3. Mr.R.M.Anbunithi, learned Additional Public Prosecutor accepts notice for the respondents 1 and 2. He submits that it is a case of case and counter, no previous case is pending against the petitioner and injured has already been discharged from the hospital.

4. Considering the facts and circumstances of the case, this Court is inclined to pass the following orders :- 1)The petitioner shall appear before the learned II Additional Sessions Judge (PCR Act Cases) Tirunelveli, within a period of 15 days from the date of receipt of a copy of this order.

2)On such surrender along with notice served to the defacto complainant, the concerned Judge shall consider the bail application filed by the petitioner and pass orders on merits on the same day of his surrender, after hearing the defacto complainant by complying with Section 15(5) of the Act.

5. With the above observation, this Criminal Original Petition is disposed of.
