J U D G M E N T

(Judgment of the Court was delivered by G.K.I, J.) This Civil Miscellaneous Appeal has been preferred as against the Judgment and decree passed in H.M.O.P.No.447 of 2023 on the file of the Family Court, Karur, thereby dismissed the diverse petition filed by the appellant herein.

2. Pending this Appeal, the matter was referred before the Mediation and Conciliation Centre attached to this Court for amicable settlement. Accordingly, both the appellant and the respondent had settled their issues amicably by way of settlement agreement dated 04.02.2026. The terms of the settlement are as follows: "6. The following settlement has been arrived at between the parties hereto:

a. The Appellant/Wife has received 7 Sovereign gold jewelry from the Respondent/Husband today.

b. The Respondent/Husband has received Thali weighing about 1⁄2 Sovereign gold from the Appellant/Wife today.

c. Appellant/Wife undertakes that she will not initiate any further legal proceedings in OS.No. 620 of 2021 on the file of Additional Sub Court, Karur.

d. Appellant/Wife is agreed for visiting right to the Respondent to see their daughter by name Aadvika at the school premises on the last Monday of every month at 4. PM.

e. Both parties are agreed for consent divorce. The Respondent/husband has no objection to allow the CMA (MD) No.514 of 2024 on the file of this Honorable Court.

7. By singing this Agreement the parties hereto state that they have further claims or demands against each other with respect to CMA (MD) No. 514 of 2024 (Case No) and all the disputes and differences in this regard have been amicably settled by the parties hereto through the process of conciliation/Mediation."

3. In view of the above settlement arrived between the parties, this Civil Miscellaneous Appeal is disposed of in terms of the settlement agreement dated 04.02.2026. The said settlement agreement dated 04.02.2026 shall form part of the records. There shall be no order as to costs.
