: Respondents PRAYER: Petition is filed under Article 226 of the Constitution of India praying for the issue of a Writ of Certiorarified Mandamus to call for the records pertaining to the impugned intimation sent by the 2nd respondent in Application No.6968, dated 08.06.2016 and quash the same as illegal and consequently direct the 1st respondent to consider the appointment of the petitioner to the post of Office Assistant on the basis of her qualifications. ORDER
(Order of the Court was made by M.M.SUNDRESH, J.) The petitioner challenges the impugned intimation sent dated 08.06.2016 with a consequential prayer to consider her appointment to the post of Office Assistant.
2.In the counter affidavit in Paragraph No.10, the following statement has been made:
"10.I respectfully submit that the writ petitioner has possessed 8th standard. She belongs to BC category and her age as on cut off date in 33 years. As per the Notification issued by this Court the age limit for BC candidate is 32 years. According to proviso Rule 12(d) of Tamil Nadu State and Subordinate Service Rules, for direct recruitment to a post included in a service for which the minimum qualification required is not higher than the minimum general education qualification, the age limit prescribed shall be increased by two years in https://hcservices.ecourts.gov.in/hcservices/ 1/2
W.P.(MD)No.10861 of 2019 respect candidates belonging to BC (Muslims), BC, MBC and DNC who do not possess a general education qualification which is higher than the minimum general education qualification. Since, the writ petitioner has not possessed above 8th standard, she has not been considered for age relaxation of 2 years as per proviso 12(d) of Tamil Nadu State and Subordinate Service Rules. Hence, she has not been called for the Certificate Verification and the application of the writ petitioner has rejected by the 1st respondent as Age Barred." (sic)
3. The aforesaid submission is not denied or disputed. Not only the age limit, the petitioner does not have the educational qualification also. In such view of the matter, we are not inclined to entertain this writ petition. Accordingly, this writ petition is dismissed. No costs.
