PRAYER: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus directing the second and third respondents to grant necessary permission for conducting thiruvizha festival from 13.06.2022 to 17.06.2022 on the basis of earlier permission granted by the Tahsildar, during the first peace committee meeting held on 13.05.2022 at Sri Arulmighu Muthumariamman Temple, Kalipatti Village, Majara, Thuraiyur Taluk, Trichy District, by considering the petitioner representation dated 30.05.2022.

O R D E R

This petitioner filed this Writ Petition seeking for issuance of a Writ of Mandamus directing the second and third respondents to grant necessary permission for conducting Thiruvizha festival from 13.06.2022 to 17.06.2022, on the basis of earlier permission granted by the Tahsildar, during the first peace committee meeting held on 13.05.2022 at Sri Arulmighu Muthumariamman Temple, Kalipatti 1/3

Village, Majara, Thuraiyur Taluk, Trichy District, by considering the petitioner's representation dated 30.05.2022. 2.Mr.M.Sakthi Kumar, learned Government Advocate (crl.side) takes notice for the respondents 1 and 3 and Mr.A.Baskaran, learned Additional Government Pleader takes notice for the third respondent. By consent, this writ petition is taken up for final disposal at the admission stage itself.

3.The learned counsel for the petitioner submitted that elaborate arrangements have been made for conducting festival at Sri Arulmighu Muthumariamman Temple, Kalipatti Village, Majara, Thuraiyur Taluk, Trichy District from 13.06.2022 to 17.06.2022. In the earlier peace committee meeting held on 13.05.2022, the Tashilar granted permission to conduct festival and in the subsequent meeting held on 17.05.2022, it was decided not to conduct the festival. Under these circumstances, the petitioner gave another representation to the third respondent, namely Sub Inspector of Police on 30.05.2022 seeking permission to conduct festival. Till date, no order was passed by the third respondent. Hence, the petitioner filed the present petition.

4.The learned Additional Government Pleader appearing for the third respondent submitted that if a fresh representation is addressed to the proper officials, they are ready to consider the same.

5. Having considered the submission of the learned counsel for the petitioner and the assurance given by the learned Additional Government Pleader, the petitioner is hereby directed to give a fresh representation to the proper authorities, namely, the Inspector of Police, Thuraiyur Police Station, Trichy District and the Tahsildar, Thuraiyur Taluk Office, Trichy District. On receipt of such representation, the authorities are directed to consider the said representation, in the light of the Circular issued by the Director General of Police, Tamil Nadu, Chennai in Rc.007301/Genl.I (1)/2019 dated 09.04.2019 and pass suitable orders on or before 13.06.2022.

6.With the above direction, this Writ Petition is disposed of. No costs.
