Prayer : Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus, directing the respondents 1 and 2 to consider the petitioner's representation dated 26.03.2019 vide letter reference Na.Ka.No 302/1428/A4 and to cancel the planning permission for the construction of building at Survey No 2184, Sannathi Street, Thiruvanaikoil, Trichy - 620 005. ORDER
The present Writ Petition has been filed by the Executive Officer of the temple challenging the building plan approval granted by the respondents 1 and 2 in favour of the respondents 3 to 8. 2.According to the learned counsel appearing for the writ petitioner, the land belongs to the temple and, therefore, the building plan approval granted in favour of the private respondents would affect the rights of the petitioner temple.

3.He also brought to the notice of the Court that a civil suit has been filed by the petitioner temple in O.S.No.267 of 2019 on the file of the Additional District Court, Trichirappalli for the relief of declaration of title and permanent injunction. Despite the grant of interim orders in the present writ petition, no interim orders have been granted in the suit so far, and the suit is ripe for trial.
4.In view of the fact that the petitioner has already preferred a civil suit before the competent Court, this Court is not inclined to entertain the present writ petition.
5.Leaving open all the submissions to be made by the petitioner as well as the private respondents, this Writ Petition stands disposed of. No costs. Consequently, connected miscellaneous petitions are closed. 08.01.2026 NCC : Yes / No Index : Yes / No Internet : Yes / No MGA 3/5
