PRAYER : Writ Petition filed under Article 226 of the Constitution of India praying for issuance of a Writ of CERTIORARIFIED MANDAMUS, to call for the records pertaining to the impugned orders/check slips passed by the 2nd respondent in RFL/Usilampatti/10/2025 dated 14.03.2025 and to quash the same consequently, to direct the 2nd respondent to register the sale deed dated 13.03.2025 and to release the same within the time stipulated by this Court. ORDER
The present Writ Petition has been filed for the issuance of a Writ of 1/4
Certiorarified Mandamus, to quash the impugned orders / check slips passed by the 2nd respondent in RFL/Usilampatti/10/2025, dated 14.03.2025 and consequently, to direct the 2nd respondent to register the sale deed dated 13.03.2025 and to release the same within the time stipulated by this Court. 2.The objections raised by the respondents is that the land belongs to a temple.
3.On scrutiny of the documents, it is seen that six persons have purchased the property in order to construct a temple. Subsequently, the said six persons had dropped the plan of construction of the said temple The petitioner is one of the six persons who purchased the property. In such circumstances, the land cannot be considered as a temple land. The said six persons are selling the land to some third party. The petitioner has filed the writ petition on behalf of all the six persons to sell the property.
4.Therefore, the impugned order raising the said objection is incorrect. Hence, the impugned orders are quashed and the 2nd respondent is directed to register the sale deed dated 13.03.2025 and to release the same within a period of four weeks from the date of receipt of a copy of this order. 5.With the above observations, this Writ Petition is allowed . shall be no order as to costs.
