Heard both sides.

2. The petitioner seeks renewal of his passport.

3. When the matter was taken up for hearing, the learned Government Advocate submitted that the criminal case registered against the petitioner has culminated in C.C.No.638 of 2022 on the file of the Judicial Magistrate, Karaikudi. The learned counsel appearing for the petitioner points out that the major offence of that case is only Section 506(2) IPC and that the petitioner is figuring as A20.

4. In a case of this nature, issuance of passport need not be denied. The petitioner is given liberty to move the learned trial Magistrate, Karaikudi seeking the relief now sought for. As and when such a petition is filed, it shall be numbered immediately and allowed within a period of three weeks thereafter. It is open to the learned trial Magistrate to stipulate appropriate conditions. The validity of the petitioner's passport shall not be restricted. 2/4

5. With this liberty to the petitioner to move the learned trial Magistrate and the aforesaid direction to the learned trial Magistrate, this writ petition stands allowed. No costs.
