PRAYER : Criminal Original Petition is filed under Section 482 of Cr.P.C, directing the respondent to file the final report in Crime No.673 of 2017, dated 23.04.2017, pending on the file of the respondent. For Petitioner : Mr.N.Shyllappa Kalyan For Respondent : Mr.SS.Madhavan Government Advocate (Criminal Side) O RDER This Criminal Original Petition is filed seeking for a direction to the respondent Police to complete the investigation in Crime No.673 of 2017 within a time stipulated by this Court. 1/4

2. Learned Government Advocate (Criminal Side) has submitted a status report stating that the Police have completed the investigation and prepared the final report and made two attempts to serve notice to the defacto complainant, but, he refused, on which, notice has ultimately sent by Registered Post with acknowledgement due and thereby, they are prepared to file a final report before the concerned Magistrate Court within a period of one week and a report called for from the concerned Court, indicates that the charge sheet has not been filed.

3. Since investigation has already been completed and Police is intending to file final report, there is no purpose in keeping this petition pending any more.

4. Considering the circumstances, this Criminal Original Petition is dismissed. However, the petitioner is at liberty to challenge the final report filed before the concerned Judicial Magistrate Court, if she is advised so.
