Respondents Prayer:- Petition filed under Article 226 of the Constitution of India praying for issuance of Writ of Mandamus directing the respondents to grant Special Grade Pay in the post of Secondary Grade Teacher to the petitioner from 07.12.2011 instead of 27.02.2018 and also revise the pay scale of the petitioner by taking into consideration of 6th pay commission issued on 01.06.2009 along with consideration of unearned leave period available to the petitioner in the aided school consequently direct the respondents to grant all consequential monetary benefits payable to the petitioner.

The relief sought for in the present writ petition is to grant Special Grade on completion of 10 years of Selection Grade in the post of Secondary Grade Teacher.
2. The petitioner is working as Secondary Grade Teacher and was awarded with Selection Grade on account of completion of ten years of service.
3. The learned counsel for the petitioner made a submission that on completion of 10 years in the Selection Grade post, the petitioner is eligible for Special Grade and it was granted belatedly during the year 2018 instead of 2011. https://hcservices.ecourts.gov.in/hcservices/ 1/2

4. This Court is of the considered opinion that Selection Grade and Special Grade are to be granted strictly in accordance with the terms and conditions stipulated. Selection Grade and Special Grade are granted by fixing the scale of pay applicable to the promotional post. Therefore, the criteria fixed for Selection Grade and Special Grade are to be followed before granting the same. Under these circumstances, the respondents are directed to verify the service particulars of the writ petitioner and find out the eligibility or otherwise in accordance with the scheme of Selection Grade and accordingly, pass appropriate orders as expeditiously as possible. The petitioner is at liberty to submit all the relevant documents along with a representation, if any, to the respondents for redressal of her grievances.
5. With the above direction, this Writ Petition stands disposed of. No costs.
