PRAYER: Petition filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus, directing the respondent to remove the encroachment in the acquired lands and service roads owned by the respondent in NH-45B-National Highways situated at Valayankulam Village, Thirupparankundram Taluk, Madurai District on the basis of the petitioner's representation dated 08.12.2018 within a time frame to be stipulated by this Court.

ORDER

(Order of the Court was made by S.M.SUBRAMANIAM, J.) The learned counsel appearing for the petitioner would submit that during pendency of the Writ Petition, the National Highways Authorities have conducted inspection, survey and identified the encroachments. However, the learned counsel appearing for the respondent would submit that encroachments were already removed and construction of bridge work is going on. 2.In view of the said submission made by the learned counsel for the respondent, no further consideration is required in this Writ Petition. However, if any other encroachment remains in the National Highways properties, the petitioner is at liberty to submit a complaint before the authorities competent and the authorities competent shall initiate appropriate action to evict the encroachers and utilize the Highways properties for road projects. 3.With the above observation, this Writ Petition is disposed of. No costs.
