Respondent Prayer : Writ Petition is filed under Article 226 of the Constitution of India to issue a Writ of Mandamus, to directing the Respondent to number and initiate proceedings based on the application filed by the petitioner before the respondent dated 01.03.2021 under the Maintenance and Welfare of Parents and Senior Citizens Act, 2007 and complete the proceedings within a time frame as stipulated by this Court.

O R D E R

This Writ Petition has been filed for the issue of a Writ of Mandamus directing the respondent to conduct an enquiry on the application submitted by the petitioner on 01.03.2021 under the Maintenance and Welfare of Parents and Senior Citizens Act, 2007 (hereinafter called as "the Act").

2. The case of the petitioner is that he had settled all his properties in the name of his son and he is now left in lurch and he is not taken care of. Therefore, the petitioner filed an application before the respondent on 01.03.2021 to take action under the Act. Since the same was not considered, the present Writ Petition has been filed before this Court seeking for appropriate directions.

3. Heard Mr.S.Sarvagan Prabhu, learned counsel appearing for the petitioner and Mr.R.Suresh Kumar, learned Government Advocate appearing for the respondent.

4. Taking into consideration the facts and circumstances of the case and the limited relief sought for in this Writ Petition, there shall be a direction to the respondent to act upon the application submitted by the petitioner on 01.03.2021 and pass appropriate orders in accordance with law after affording https://hcservices.ecourts.gov.in/hcservices/ 1/2

W.P.(MD).No.11740 of 2021 opportunity to the petitioner and his son, within a period of six weeks from the date of receipt of a copy of this order.

5. The petitioner is directed to make a fresh representation to the respondent along with all the relevant documents and also a copy of this order.

6. This Writ Petition stands disposed of with the above directions. No costs.
