Petition filed under Article 226 of the Constitution of India, praying for issuance of a writ of Habeas Corpus directing the respondents herein to produce the body or person of the Petitioner s wife and child namely Sasikala aged 25 and minor Mohanprasath aged 2 years respectively and hand over the custody of petitioner minor son to the petitioner before this Honourable Court and set them at liberty.

ORDER

(Order of the Court was made by M.V.MURALIDARAN, J.) The petitioner one Arumugam has filed this Habeas Corpus Petition stating that he married the 1st detenue, namely Sasikala aged 25 years and out of their marriage, 2nd detenu, namely, Mohanprasath aged 2 years was born and both of them were missing from 19.03.2016. Hence, he has preferred a complaint on 21.03.2016 to the 2nd respondent. Pursuant to which, a case has been registered for 'woman and child missing' and the same is under investigation.

2.Heard the learned counsel for the petitioner and the learned Additional Public Prosecutor for the respondents 1 and 2. 3.The learned Additional Public Prosecutor, on instructions, submitted that the first detenue, namely, Sasikala eloped with the third respondent Jeyakumar. The said statement is recorded. 4.Recording the said submission, this petition is closed directing the respondent police to expedite the investigation.
