ORDER : The Court Made the following order :- The petitioners are in custody since 17.07.2018 for the offence under Section 306 I.P.C. in Crime No.402 of 2018 on the file of the respondent Police and seek bail.
2.The first petitioner is the husband of the deceased, while the second petitioner is the father-in-law of the deceased. It appears that the second petitioner / father-in-law misbehaved with the deceased, leading to her suicide. Therefore, this Court grants bail only to the first petitioner.
3.This Criminal Original Petition is dismissed as far as the second petitioner is concerned.
3.Considering the facts and circumstances of the case, this Court is inclined to grant bail to the first petitioner with certain condition. Accordingly, the first petitioner is ordered to be released on bail, subject to the following conditions; (i) the first petitioner shall execute a bond for a sum of Rs.10,000/- (Rupees Ten Thousand Only) with two sureties, each for a like sum to the satisfaction of the learned Judicial Magistrate, Andipatti, Theni District. https://hcservices.ecourts.gov.in/hcservices/
(ii)the first petitioner is directed to appear before the respondent police as and when required for interrogation. (iii)on breach of any of the aforesaid conditions, the Magistrate/Trial Court is entitled to take appropriate action against the first petitioner in accordance with law as if the conditions have been imposed and the first petitioner on bail by the Magistrate/Trial Court himself as laid down by the Hon'ble Supreme Court in P.K.Shaji vs. State of Kerala [(2005) AIR SCW 5560].
