Prayer: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Certiorarified Mandamus calling upon the impugned refusal check slip culminated in refusal check slip No.RFL/3 No Joint Sub Registrar, Trichy /114/2026 dated 01.04.2026 on the file of the respondent and quash the same as illegal null and void ultra vires, without jurisdiction and without authority and for mandamus directing the respondent to register the pending sale deed No.TP/264142034/2026 dated 01.04.2026 within a specific time limit that may be fixed by this Honourable High Court and pass such other or further orders as this Honble Court may deem fit and proper in the circumstances of this case and thus render justice.

ORDER

The present writ petition has been filed challenging the impugned refusal check slip dated 01.04.2026. Upon perusal of the same, it can be seen that when the petitioner presented a Sale Deed for registration, the same was rejected citing that O.S. No. 241 of 2023 is pending before the learned I Additional District Judge, Tiruchirappalli.

2. The learned counsel appearing for the petitioner would submit that there is no interim order in the said Suit. Moreover, the Suit has been filed by the petitioner himself to protect his proprietary rights.

3. Per contra, the learned Government Advocate appearing on behalf of the respondent would submit that an order has been passed in light of the pendency of the Suit.

4. However, the mere pendency of the Suit cannot be a bar for registration of document in the absence of any interim order restraining the party presenting it from doing so.

5. In view thereof, the writ petition is disposed of on the following terms:- i. The impugned refusal check slip dated 01.04.2026 stands quashed.

ii. The petitioner is directed to represent the document within a period of two weeks from the date of receipt of a web copy of the order, without waiting for the certified copy of the order. iii. Upon receipt of the same, the respondent is directed to register the document, if there is no other impediment.

iv. No costs.
