PETITION FOR BAIL Under Sec.439 of Cr.P.C.

PRAYER :-For Bail in Crime No.511 of 2021 on the file of the Respondent Police.

ORDER : The Court made the following order :- The petitioner, who was arrested on 05.06.2021 for the offences punishable under Section 4(1)(aaa) r/w Section 4(1-A) of the Tamilnadu Prohibition Act in Crime No.511 of 2021 on the file of the respondent police, seeks bail.

2.The case of the prosecution is that on 05.06.2021, at about 09.00 pm., the petitioner was found in possession of 110 liters of Pandicherry arrack at Sholiyavilagam. Hence, the complaint. 3.The learned counsel for the petitioner would submit that the petitioner is an innocent person and he has been falsely implicated in this case.

4.The learned Government Advocate(Crl.Side) appearing for the respondent opposed this petition on the ground that investigation is not completed and the petitioner has 10 similar previous cases pending against him.

CRL OP(MD)No.9318 of 2021 5.Considering the nature of the case and the fact that investigation is not completed and also the fact that the petitioner has 10 similar previous cases pending against him, this Court is not inclined to grant bail to the petitioner. Accordingly, this criminal original petition is dismissed.
