Writ Petition is filed under Article 226 of the Constitution of India, praying this Court S-15.To issue a writ of Certiorarified Mandamus or any other appropriate writ order or directions to call for the records from the 2nd Respondent pertaining to the impugned order passed by the 2nd Respondent in Ref.No.TNSTC/TS/T4/02/2020 dated 16-11-2020 and quash the same and further direct the respondents to allow the petitioner to join duty and allocate work to the petitioner within a stipulated time fixed by this Honourable Court.

2. Today, when the matter is taken up for hearing, the learned Standing Counsel appearing for the respondents submits that this Court, vide order dated 04.12.2020, directed the respondents to disburse the subsistence allowance to the petitioner for the suspension period from 24.02.2020 to 01.03.2020, within a period of two weeks. Pursuant to the direction of this Court, subsistence allowance was paid to the petitioner. He further submits that though the petitioner was called for to join duty on 02.03.2020, he did not join the duty. Therefore, disciplinary action was initiated against the petitioner and after the enquiry, he was dismissed from service. The said submission is disputed by the learned counsel for the petitioner that the petitioner attended the office on 02.03.2020, but, he was not allotted any work.
