This Criminal Original Petition has been filed to direct the learned Judicial Magistrate, Tiruchendhur to dispose of the case in C.C.No. 16 of 2020 within the stipulated period. 2.According to the petitioner, the petitioner is the defacto complainant in this case. Based on her complaint, a case has been registered by the respondent police in Cr.No.81 of 2019 against the accused persons. Though the case has been registered in the year 2019, so far trial has not been commenced. Therefore, seeks for speedy disposal this petition has been filed.
3.The learned Government Advocate (Crl.Side) would submit that based on the complaint of the petitioner, a case has been registered in Cr.No.81 of 2019 for the offence punishable under Sections 448, 294(b), 323, 352, 147, 148 of IPC. After completion of investigation, they have filed the charge sheet before the concerned Court. The case is posted for examination of witnesses 1 to 5. The respondent police is ready to produce the witnesses as directed by the trial Court and co-operate to complete the trial proceedings. 2/4
4.Considering the limited scope of the prayer sought for by the petitioner and also considering the long pendency of the case, this Court hereby direct the learned Judicial Magistrate, Tiruchendhur to complete the trial proceedings in C.C.No.16 of 2020 as early as possible without giving long adjournments, beyond 1 week. 5.With the above direction, this Criminal Original Petition stands disposed of.
