ORDER
This Civil Revision Petition is filed challenging the fair and decreetal order dated 02.01.2025 passed in I.A.No.1 of 2024 in O.S.No.7 of 2024 by the Sub Court, Kovilpatti.
2.Since no adverse order is going to be passed as against the respondent, notice to the respondent is dispensed with. 3.The petitioner filed a money suit in O.S.No.7 of 2024 before the Sub Court, Kovilpatti as against the respondent. In that suit, the petitioner filed I.A.No.1 of 2024 seeking attachment of the property before judgment. The said application was rejected. Challenging the same, the present Civil Revision Petition is filed.
4.This Court perused the entire records. Perusal of the records shows that the petitioner filed the interlocutory application seeking attachment before judgment. The money suit is filed for recovery of a sum of Rs.5 lakhs. Merely for a sum of Rs.5 lakhs, the entire property of the respondent cannot 2/4
be sought to be attached. The trial Court has rightly appreciated the same and rejected the application filed by the petitioner. Hence, the order passed by the trial Court cannot be interfered. Accordingly, this Civil Revision Petition is dismissed. However, there shall be a direction to the trial Court to dispose of the suit within a period of six months from the date of receipt of a copy of this order. No costs.
