PETITION FOR BAIL Under Sec.439 of Cr.P.C.

PRAYER :-For Bail in Crime. No. 493 of 2021 on the file of the Respondent Police.

ORDER : The Court made the following order :- The petitioner, who was arrested on 04.06.2021 for the offences punishable under Section 4(1)(aaa) r/w Section 4(1-A) of the Tamilnadu Prohibition Act in Crime No.493 of 2021 on the file of the respondent police, seeks bail.

2.The case of the prosecution is that on 04.06.2021, at about 11.00 am., the petitioner was found in illegal possession of 110 liters of Pandicherry arrack at Serukadampur. Hence, the complaint. 3.The learned counsel for the petitioner would submit that the petitioner is an innocent person and he has been falsely implicated in this case.

4.The learned Government Advocate(Crl.Side) appearing for the respondent opposed this petition on the ground that investigation is not completed and the petitioner has 7 similar previous cases pending against him.

CRL OP(MD)No.9327 of 2021 5.Considering the nature of the case and the fact that investigation is not completed and also the fact that the petitioner has 7 similar previous cases pending against him, this Court is not inclined to grant bail to the petitioner. Accordingly, this criminal original petition is dismissed.
