Respondents Prayer : This Writ Petition has been filed under Article 226 of the Constitution of India praying for a Writ of Mandamus directing the respondents to consider the petitioner's representation dated 08.12.2014 within the time stipulated by this Court.

For petitioner : Mr.E.Balasubramanian For respondents : Mr.N.Manoharan Special Government Pleader

ORDER

The petitioner has come forward with this Writ Petition praying for a Writ of Mandamus directing the respondents to grant disability fund by considering his representations dated 29.10.2014 and 08.12.2014.

2. The learned counsel appearing for the petitioner would submit that the petitioner is a blind person and the respondents stopped the welfare fund stating that the petitioner is with their parents and therefore, he need not be granted with such welfare fund. Due to which, the petitioner suffers a lot to lead his life. Hence, he prayed for allowing this Writ Petition.

3. On notice, the learned Special Government Pleader appearing for the respondents would submit that the representations of the petitioner will be considered in accordance with law.

4. A perusal of the affidavit would indicate the fact that the petitioner is 100% disability person and a Certificate has also been given to that effect. Though he was receiving disability pension fund, it was stopped abruptly since 2014 on the ground that the petitioner is living with the parents. Such reason is unfounded for the reason that being a blind person definitely the petitioner has to depend on his family members. Although there is no rejection order passed by the respondents, placed before this Court, the first respondent is directed https://hcservices.ecourts.gov.in/hcservices/

to pass appropriate orders on the representations of the petitioner, dated 29.10.2014 and 08.12.2014, in letter and spirit and on merits and in accordance with law, within a period of four weeks from the date of receipt of a copy of this order.

With the above direction, this Writ Petition stands disposed of. No costs.
