PRAYER : Criminal Original Petition is filed under Section 482 of Cr.P.C, to direct the 1st and 2nd respondents to provide adequate police protection to the petitioner and his son in respect of the property in S.No.365/3C an extent of 12 cents at K.Vellangulam Village, Kallikudi Sathiram, T.Kallikudi, Madurai District, by considering the petitioner's representation dated 24.08.2020. This criminal original petition has been filed seeking a direction, to direct the first and second respondents to provide adequate police protection to the petitioner and his son, in respect of the property in S.No.365/3C to an extent of 12 cents at K.Vellangulam Village, Kallikudi Sathiram, T.Kallikudi, Madurai District, by considering the petitioner's representation dated 24.08.2020.
2.Heard the learned counsel appearing for the petitioner and the learned Government Advocate(Crl.side) appearing for the respondent police.
3.Today, when the petition is came up for hearing, the learned Government Advocate appearing for the respondents 1 and 2, on instructions, would submit that upon representation dated 24.08.2020 given by the petitioner, the second respondent herein conducted an enquiry in C.S.R.No.43 of 2020 dated 12.09.2020. Crl.O.P.[MD]No.9728 of 2020 day, after advising the petitioner and the respondents 3 and 4 to approach the competent Court, since the dispute between the petitioner and the respondents 3 and 4 are relates to the immovable property. The said statement is recorded.
4. At this juncture, the learned counsel appearing for the petitioner would submit that even after closing the enquiry, the respondents 3 and 4 are creating problem to the petitioner.
5. In this regard, the only option available to the petitioner is to lodge a complaint before the police in accordance with law and otherwise in the absence of any representation, this Court cannot direct the respondent police to provide adequate police protection.
6.With the above observation, this Criminal Original Petition is closed.
