O R D E R

This petition has been filed for issuing a direction to the first respondent herein not to harass the petitioner in the name of enquiry.

2. When the matter was taken up for hearing the learned Additional Public Prosecutor appearing for the prosecution would submit that the allegation of job racketing has been received against the petitioner from the second respondent.

3. Per contra, the learned counsel appearing for the petitioner submits that the petitioner is a creditor, while the second respondent is a debtor. A sum of Rs.3,00,000/- has been given by the petitioner to the second respondent through account payee transaction and the petitioner also produced a pro-note issued by the second respondent in favour of the petitioner.

4. It is prima facie seen that the case is civil in nature. Be that as it may, the petitioner is directed to appear before the first respondent on 04.08.2018 at 10.00 am and the second respondent is also directed to present before the first respondent on that day. The petitioner shall co-operate for enquiry. If the first respondent proposes to register First Information Report against the petitioner, the first respondent shall give notice under Section 41(A) Cr.P.C., so https://hcservices.ecourts.gov.in/hcservices/

that the petitioner will have adequate time for filing an anticipatory bail petition.
