RESPONDENTS Petition praying that in the circumstances stated therein and in the affidavit filed therewith the High Court will be pleased to issue a Writ of Mandamus, directing the respondents to permit the petitioner to writ the examination for the subject of Macro Economics-II, (Subject Code: JMEC61) as per schedule on 08.05.2019. ORDER : This petition coming on for orders upon perusing the petition and the affidavit filed in support thereof and upon hearing the arguments of Mr.T.ANTONY ARUL RAJ, Advocate for the petitioner and of Mr.M.MEHABOOB ATHIFF, Advocate for R1, the court made the following order:-

1. Learned counsel appearing for the second respondent College, on instructions and on the basis of the counter affidavit, would submit that, the petitioner is lacking attendance in the particular paper of the final semester in his course to the extent of 3%, which means, the required minimum percentage was 60%, whereas, the petitioner earned only 57% in the particular subject and that is the reason why, he was not permitted to write the exam, but anyhow pursuant to the impugned order passed by this Court, the student has written the exam but the results have not been published.

2. However, Mr.M.Mehaboob Athiff, learned standing counsel appearing for the first respondent University, on oral instructions, would submit that, the petitioner has to repeat the semester in respect of the particular paper, after paying the condonation fee https://hcservices.ecourts.gov.in/hcservices/

under the rules of the University. However, the learned standing counsel is not able to produce any such written instructions and hence he seeks for a short accommodation to get written instructions.
