Respondents PRAYER: Petition under Article 226 of the Constitution of India seeking issuance of a writ of Mandamus, directing the respondents forthwith to ensure proper implementation of 25% reservation quota for children belonging to weaker sections and disadvantaged group in the neighbourhood as per section 12(1)(c) of the Right to Children to Free and Compulsory Education Act, 2009, in the non-minority and unaided private matriculation schools in and around Tirunelveli District by creating awareness among the public. [Order of the Court was made by T.S.SIVAGNANAM, J.] Heard Mr.R.Pon Karthikeyan, learned counsel appearing for the petitioner and Mr.A.K.Manickam, learned Standing Counsel for Government, appearing for respondents.
2.The writ petitioner seeks for a direction upon the respondents to forthwith ensure proper implementation of 25% reservation quota for children belonging to weaker sections and disadvantaged group in the neighbourhood as per section 12(1)(c) of the Right to Children to Free and Compulsory Education Act, 2009, in the non-minority and unaided private matriculation schools in and around Tirunelveli District by creating awareness among the public. 3.The petitioner, who appears to pursue a law course, has filed the Writ Petition. From the averments made in the affidavit filed in support of the Writ Petition, we find the same as absolutely vague. The petitioner, who is desirous of becoming a lawyer, after completing the law course, should come forward with a specific case, for which more research is required. On the affidavit pleadings we cannot issue a Mandamus.
4.In view of the above, the Writ Petition is disposed of the Writ Petition, giving liberty to the petitioner to make a thorough study of the pilot district, which has been chosen, namely, Tirunelveli District and approach the authorities through representations and if no response is forthcoming, approach this Court for necessary relief. No costs. Consequently, connected Miscellaneous Petitions are closed.
