Writ Petition is filed under article 226 of the Constitution of India, praying to issue a Writ of Certiorarified Mandamus, calling for the records, pertaining to impugned order of the respondent in Refusal No.RFL/BODINAYAKANUR/8/2026 dated 23.02.2026 and quash the same and consequently, direct the respondent to register the petitioner's sale deed dated 06.02.2026 in respect of the property in Survey No.2/2, Thirumalapuram Kaliamman Street, Bodinayakanur, Municipal Town, Theni District.

ORDER
The writ petition is filed challenging the impugned refusal Check slip dated 23.02.2026.
2.The case of the petitioner is that the petitioner being the legatee under a Will executed the sale deed and presented the same for registration. The same is refused by the impugned refusal check slip. On a perusal thereof, it can be seen that it is refused on the ground that the Will is unregistered and that it is not probated. Both the registration of the Will and the probation of the Will are not mandatory and it is only optional. 3.In view thereof, the reasons that are mentioned in the refusal check slip are not sustainable, this writ petition is ordered on the following terms: (i)The impugned refusal check slip dated 23.02.2026 shall stand quashed.
(ii)The petitioner shall, within one week from the date of receipt of the web copy of the order, re-present the said document before the respondent and the respondent shall register the same, if there is no other impediment.
(iii)No costs.
