Heard on both sides.

2.The petitioner is facing trial in S.C.No.39 of 2024 on the file of the Special Court for exclusive trial of Cases under POCSO Act, Madurai. On 20.08.2024, trial commenced and PW1 and PW2 were examined and Ex.P1 and Ex.P2 were marked. On 27.08.2024, PW3 and PW4 were examined and Ex.P3 was marked. On 29.08.2024, PW5 was examined and Ex.P4 was marked. On 02.09.2024, Ex.P5 to P9 were marked. It appears that in the month of January 2025, the petitioner filed Cr.M.P.No.167 of 2025 praying to re-call PW1 to PW4 and the same was allowed on 1/3

19.03.2025 and summons were issued to PW1 to PW4. On 23.04.2025, PW1 was not present. Hence the case is posted to 07.05.2025 for examination of PW1. In this circumstances, this Court is of the considered view that there is no need to modify the condition No.6(iii) imposed vide order dated 30.08.2024 in Crl.O.P.(MD) No.13416 of 2024. This Court does not find any merit in the petition. Accordingly, this Criminal Miscellaneous Petition is dismissed.
