PRAYER: Petition filed under Section 482 Code of Criminal Procedure, directing the second respondent not to harass the petitioner under the guise of enquiry and also not to interfere in the civil dispute prevailing between the petitioner and the respondents 3 to 5. This petition is filed seeking a direction to the respondents 1 & 2 not to harass the petitioner and not to interfere in the civil dispute.
2.The case of the petitioner is that the petitioner purchased a property to an extent of 654 sq.ft in Thenpalani Village, Thiruparakundram Taluk, Madurai. He started to construct a building in the said property. At that time, the respondents 3 to 5 caused trouble to the petitioner. Hence, the petitioner submitted a representation to the respondent police on 02.07.2021. Since no action has been taken by the respondent police, the petitioner is before this Court with the present Criminal Original Petition. https://hcservices.ecourts.gov.in/hcservices/ 1/2
Crl.O.P(MD)No.9384 of 2021 3.The learned Additional Public Prosecutor would submit that based upon the complaint given by the third respondent, enquiry in CSR No.330 of 2021 was undertaken and during the course of the enquiry, it was found that the issue involved in this matter is civil in nature and the parties were advised to approach the concerned civil Forum to redress their remedy and accordingly it was closed on 13.07.2021.
4.Recording the submission fof the learned Additional Public Prosecutor that the enquiry has been closed, nothing survives for further consideration or direction in this petition. Accordingly, this Criminal Original Petition is disposed of.
