PRAYER: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Certiorarified Mandamus calling for the records pertaining to the impugned order passed by the fifth respondent in O.Mu.A3/5556/2021, dated 29.1.2022 and quash the same as illegal and direct the respondents 4 and 5 to register the Adangal and issue patta to the Petitioner for the land to an extent of 13 cents comprised in S.NO. 233/15, situated at Rasathiamman Kovil Street, Kavalkarapalayam, Sirugmani East Village, Srirangam Taluk, Trichy District within the time frame fixed by this Court. O R D E R

The Writ Petition is filed challenging the order passed by the fifth respondent negativing the request of the Petitioner seeking issuance of patta in respect of the property in Natham S.No..233/15, situated at Rasathiamman Kovil Street, Kavalkarapalayam, Sirugmani East Village, Srirangam Taluk, 2.Heard the learned counsel appearing on either side and perused the materials placed before this Court. 3.When the Writ Petition is taken up for hearing today, the 2/6

learned counsel for the Petitioner would submit that challenging the very same impugned order, the Petitioner had preferred an appeal before the fourth respondent and the same is pending. 4.A perusal of the proceedings of fourth respondent in Na.Ka.Aa5/320/2024, dated 7.8.2024 would indicate that pursuant to the appeal filed by the Petitioner, the fourth respondent already called for a report from the fifth respondent. Therefore, the Petitioner is not entitled to prosecute two parallel proceedings for the very same relief at a time. Hence, this Court is not inclined to entertain the present Writ Petition. 5.In these circumstances, the Writ Petition stands disposed of, with a direction to the fourth respondent to consider the appeal filed by the Petitioner and dispose of the same on its own merits, after affording reasonable opportunity to the Petitioner and other interested parties, if any, within a period of 12 weeks from the date of receipt of a copy of this order.
