O R D E R

This Criminal Original Petition has been filed to direct the 1st respondent to instruct the 2nd respondent police and his subordinates from harassing the petitioner in connection with the house lease agreement, which is purely a civil dispute, by considering the representation of the petitioner, dated 16.04.2025. 2.According to the petitioner, he entered into a lease agreement with one Sheeba Fathima for a sum of Rs.10 lakhs and after receiving the amount, key was handed over to the said Sheeba Fathima. Thereafter, the said Sheeba Fathima lodged a complainant against the petitioner. Based on the same, the respondent police harassed the petitioner and insisted him to pay a sum of Rs.1 lakh to the said Sheeba Fathima and the petitioner has also repaid the said amount.

Even after that they have insisted him to return the balance amount to her. Therefore, he has sent a representation to the respondent, but the same has not been considered. Hence, this petition. 3.The learned Government Advocate (Crl.

the petitioner and one Sheeba Fathima/lessee. Based on the same, a complaint has been lodged by her against the petitioner. For enquiry, they called the petitioner. Apart from that they have not harassed the petitioner and not insisted him to return the amount. However, they will conduct enquiry based on the complaint of the 3rd respondent and the representation of the petitioner in accordance with law. 4.Considering the prayer of the petitioner and the respondent police denied the alleged harassment made by the petitioner and the representation of the petitioner and the complaint of Sheeba Fathima are pending for enquiry, this Court hereby directs the 2nd respondent to conduct enquiry and take appropriate action based on the complaint of Sheeba Fathima and representation of the petitioner within a period of 15 days from the date of this order, in accordance with law and after affording opportunities to both parties.
