ORDER
This Writ Petition is filed to direct the respondents to close the old bank account No.1526234774, which is running in the second respondent Central Bank, Ellis Nagar Branch, Madurai, based on the petitioner's representation dated 07.05.2019. 2.Heard Mr.G.Pradeep Dhinakaran, learned counsel appearing for the petitioner and Mr.N.Dilip Kumar, learned Standing Counsel appearing for the second respondent.
3.According to the petitioner, he is the Secretary of Ellis Nagar Narmatha Kudiyurupor Nala Sangam from the year 2014. The President, Vice President and Secretary of the said Sangam have maintained a bank account in the second respondent. After registering the said Sangam in the new name, the old parties, the President, Vice President and the Secretary of the said Sangam gave a representation to the second respondent to close the old account, which run in the old name and they have no objection to close the https://hcservices.ecourts.gov.in/hcservices/ 1/2
W.P.(MD)No.11878 of 2019 said bank account. Thereafter, an inspection was made by the SubRegistrar and directed the President, Vice President and the Secretary of the said Sangam to open a new bank account in the name of Ellis Nagar Narmatha Kudiyurupor Sangam. Therefore, the petitioner, President and Vice President have approached the second respondent to create a new account in the name of registered authorized body. In this regard, the petitioner has made a representation dated 07.05.2019. Since no action has been taken, the petitioner is before this Court.
4.The learned Standing Counsel appearing for the second respondent submitted that there is a dispute between the members of the said Sangam and there is an objection for closing the said account. He further submitted that a suit in O.S.No.560 of 2018 has been filed before the District Munsif Court, Madurai and the same is pending.
5.Considering the submissions made on either side, this Court is inclined to direct the second respondent to serve notice to the account operators or any other interested parties and to pass appropriate final orders on the petitioner's representation dated 07.05.2019 on merits and in accordance with law, within a period of four months from the date of receipt of a copy of this order. 6.With the above direction, this Writ Petition stands disposed of. No costs.
