ORDER

This Criminal Original Petition is filed for a direction to the police / respondents 1 and 2 not to interfere in the civil dispute otherwise than due process of law.

2. It is the case of the petitioner that he has been in possession of a premises as a tenant of the Hindu Religious and Charitable Endowments Department. The third respondent who is nothing to do with the said property, has filed R.C.O.P.No.02/2007, seeking eviction of the petitioner and the same was dismissed. The appeal filed by the third respondent vide Rent Control Appeal No.19/2013 was also dismissed. It is further submitted that inspite of that the third respondent has filed a representation before the respondents 1 and 2 police and the police have been interfering and asking the petitioner to vacate the premises.

3. Learned Government Advocate (Crl.side) on the other hand submits that on a complaint received against the petitioner and also respondents, a case and counter case, have already been registered in 2/4

Crime Nos. 47 of 2023 and 48 of 2023 respectively and they are being investigated. It is also submitted that in respect of a complaint given by the third respondent, the police wants the petitioner to explain, however, the petitioner, without appearing before the police, has approached this Court with an allegation of police harassment. It is also submitted that the police never harassed the petitioner.

This Criminal Original Petition is therefore, disposed of with a direction to the petitioner to appear before the police within one week from the date of receipt of a copy of this order and within two weeks thereafter, the respondents 1 and 2 are directed to close the representation given by the third respondent.
