ORDER

This Petition is filed to condone the delay of 113 days in filing the above Civil Miscellaneous Appeal.

2. Heard the learned counsel appearing for the petitioner and the learned Counsel appearing for the Respondent Nos.1 to 3 & 5 and perused the materials placed before this Court.

3. The learned Counsel for the respondent Nos. 1 to 3 raised his formal objection in allowing this petition.

4. The learned Counsel appearing for the petitioner stated that the Respondent No.4 herein was remained ex-parte before the trial Court and hence notice to the Respondent No.4 may be dispensed with. 2/4

5. In view of the submission made by the learned Counsel for the petitioner, notice to the Respondent No.4 is hereby dispensed with.

6. For the reasons assigned in the accompanying affidavit and on being satisfied with the same, this Petition is ordered and the delay of 113 days in filing the above Civil Miscellaneous Appeal is condoned.

7. Registry is directed to number the Civil Miscellaneous Appeal, if the papers are otherwise in order.
