This writ petition has been filed for issuance of a writ of Mandamus, to direct the 1st respondent to instruct the 6th respondent to accord permission to conduct the Arulmighu Kaliamman Temple Festival (Mulaipaari, Agnichatti, Pongal) scheduled to be held on 28.05.2019 and 29.05.2019 or at any other date at Pullalakottai Village, Virudhunagar Taluk, Virudhunagar District and to provide adequate police protection on the basis of the representation dated 07.05.2019.
2. Heard the learned counsel appearing for the petitioner and the learned Additional Public Prosecutor appearing for the respondents.
3.It is seen that the petitioner filed this petition seeking permission and also police protection to conduct the festival in respect of Arulmighu Kaliamman Temple Festival (Mulaipaari, Agnichatti, Pongal) scheduled to be held on 28.05.2019 and 29.05.2019. Now, the period sought for by the petitioner to conduct the said festival is lapsed and as such, the prayer has become infructuous.
4.It is further seen that on the complaint lodged by the petitioner, the 6th respondent conducted enquiry and directed the parties to approach the civil Court to ascertain their civil rights in respect of conducting festival.
5.Considering the above fats and circumstances of the case, since the period to conduct the festival as sought for by the petitioner is lapsed, the petitioner is not entitled to get any relief in this writ petition. However, both the parties are directed to approach the civil Court to ascertain their rights insofar as the right to conduct the festival of the said temple. 6.With the above direction, this writ petition is disposed of.
