ORDER

This Petition has been filed under Section 528 of BNSS r/w 483(i)(b) of BNSS praying to modify the condition order dated 04.04.2025, in Crl.M.P.No.1501 of 2025 on the file of the Principal Sessions Judge, Tanjore. 1/4

2. Mr.G.Kadhiresan, learned counsel appearing for the petitioner submits the following reason to modify the condition No.3 of the order dated 04.04.2025, in Crl.M.P.No.1501 of 2025 on the file of the Principal Sessions Judge, Tanjore;- "The petitioner states that the petitioners 1 to 3 are struggling each and everyday. The first petitioner and her husband has been staying at Hyderabad for past 2 years and taking treatment. The first petitioner got spinal cord surgery thereby she could not move anywhere. The second petitioner by staying at Hyderabad for the past 2 years. The petitioners 2 and 3 severely affected by the heart and sugar decease and aged ailment respectively and got treatment. So far as the fourth petitioner he is partner of MNC namely 3 axle Infra Equipment. Now some equipment also imported from foreign. He only has to deal the MNC projects. Unless or otherwise relaxed the condition stated in supra in para 2 the petitioners will be caused irreparable loss"

In these circumstances, the learned counsel prays to modify the condition No.3 of the order dated 04.04.2025, in Crl.M.P.No.1501 of 2025 on the file of the Principal 2/4

Sessions Judge, Tanjore.

Mr.K.Sanjai Gandhi, learned Government Advocate (Criminal Side) has no objection to modify the condition imposed by the Court below. 4.Being satisfied with the above reasons stated in the petition, this Court is inclined to modify Condition No.3 of the order dated 04.04.2025, in Crl.M.P.No.1501 of 2025 on the file of the Principal Sessions Judge, Tanjore, as follows: "3.The petitioner shall appear before the respondent as and when required for interrogation."

5. Accordingly, this Criminal Original Petition stands allowed. The other conditions shall hold good.
