ORDER

The Criminal Original Petition has been filed to direct the first Respondent to withdraw the case in Crime No.666/2012 on the file of the fifth Respondent and entrust the same to the second Respondent for complete the investigation in accordance with law within the time stipulated by this Court.

2. Today when the matter is taken up for hearing the learned Government Advocate(Crl.side) would submit that this Court in Crl.O.P(MD).No.10136 of 2019, directed the second respondent police to conduct further investigation and file a final report within a period of one month from the date of receipt of copy of that order. As per the order of this Court, the fifth respondent police conducted enquiry in Crime No.666 of 2012 and filed a report before the concerned Court as 'Mistake of Fact'.

3.Since there was no investigation pending on the file of the fifth respondent, the transfer of investigation does not arise. Therefore, the prayer sought for in this petition has become infructuous. Accordingly, this Criminal Original Petition is dismissed and the petitioner is at liberty to approach the concerned court by way of protest petition in the manner known to law.
