ORDER
The present Transfer Civil Miscellaneous Petition has been filed to withdraw the case in I.D.O.P.No.22 of 2025 on the file of the learned Judge, Family Court, Theni and transfer the same to the file of the Family Court at Srivilliputtur, Virudhunagar District.
2. The petitioner is the wife and the respondent is the husband. The marriage between the petitioner and the respondent was solemnized on 15.12.2021 at Church, Allelooya Towers, K.Puthur, Madurai District, as per the Christian Rites and Customs.
3. Due to some matrimonial discord, the parties have separated. Therefore, the petitioner/wife initiated a proceedings in D.V.C.No.15 of 2023 before the Judicial Magistrate Court No.II, Sivakasi, Virudhunagar District and the respondent/husband filed a petition in I.D.O.P.No.22 of 2025 before the Family Court, Theni, seeking Restitution of Conjugal Rights.
4. Considering the dispute between the parties, by the ordered dated 19.06.2025, this Court referred the matter to the Mediation and Conciliation Centre attached to this Bench. Both the parties along with their respective counsel appeared before the mediation. The mediator also successfully mediated the matter, and hence, a compromise has been reached between the parties. In mediation, the following settlement has been arrived at between the parties:- i) It is submitted that both parties are settled the matter amicably.
ii) Both the parties are agreed to file the mutual divorce petition before the learned Family Court Judge at Srivilliputhur, Virudhunagar District within period of two months from today.
iii) The petitioner stated that agreed to withdraw petition in D.V.C.No.15 of 2023 on the file of the Judicial Magistrate No.II, Sivakasi.
5. In view of that, this Court is inclined to transfer the case in I.D.O.P.No.22 of 2025 from the file of the Family Court, Theni, to the file of the Family Court at Srivilliputtur, Virudhunagar District.
6. Accordingly, the Family Court, Theni, is hereby directed to transfer the entire records pertaining to the case in I.D.O.P.No.22 of 2025, to the file of the Family Court at Srivilliputtur, Virudhunagar District, within a period of four weeks from the date of receipt of a copy of this order.
7. The parties are directed to file mutual divorce petition before the Family Court at Srivilliputhur, Virudhunagar District within period of two months from today as agreed by them. The Family Court at Srivilliputhur, Virudhunagar District, shall pass appropriate orders in accordance with law on such petition being filed before the Court within a period of six weeks from the date of filing of the petition and also in I.D.O.P.No.22 of 2025.
8. Accordingly, the Transfer Civil Miscellaneous Petition stands allowed with the above direction. There shall be no order as to costs. Consequently, the connected Civil Miscellaneous Petitions is closed. 08.08.2025 Index :Yes/No Speaking Order :Yes/No :Yes/No dss To 1.The Family Court, Theni.
