Heard Mr.T.P.Balasubramaniam, learned Counsel appearing on behalf of the petitioner, Mr.B.Saravanan, learned Additional Government Pleader appearing on behalf of the respondents 1 to 3 and Mr.S.Prakash, learned Government Advocate (crl.side) appearing on behalf of the fourth respondent. By consent of both parties, considering the limited relief sought for by the petitioner, this Writ Petition is taken up for final disposal at the admission stage.
2.The petitioner seeks for issuance of a Writ of Mandamus to direct the respondents 2 an 3 to conduct survey in the presence of the 2/5
fourth respondent/ Police officials, in view of the objections of the respondents 5 and 6. The petitioner has based his claim on the patta mutated in his father's name.
3.Considering the limited relief sought for by the petitioner, the Writ Petition is disposed of directing the second and third respondents to proceed to fix a date for survey after giving notice to the fourth respondent, seeking police protection at the cost of the Writ Petitioner and also putting on notice the respondents 5 and 6 about the proposed survey. If any objections are given by respondents 5 and 6, they shall be decided on one way or other and thereafter, the survey shall be refused, proceeded with accordingly. The said exercise shall be carried out within a period of sixteen weeks from the date of receipt of a copy of this order. No costs.
