Respondents PRAYER: Writ Petition is filed under Article 226 of the Constitution of India, praying for issuance of a writ of mandamus, directing the Respondents No.1 and 2 to consider the petitioner's representation, dated 12.11.2024, and pass such further or other orders.

ORDER

The petitioner claims that her brother P.Paulraj was employed with Indian Space Research Organisation Propulsion Complex, Mahendragiri. He passed away on 12.03.2023. When he died, he left behind as his legal heirs, the petitioner - P.Geetha and her siblings - Latha, Saratha, Ambujam and Papa. The petitioner states that one Indira claims that she is the second wife of the deceased Paulraj and has obtained legal heirship certificate. The petitioner pleads that Indira was never married to her brother Paulraj.

2. Legal Heirship Certificate is nothing but a relationship certificate. If the petitioner has grievance that Indira is not the legal representative of Paulraj, the remedy is only before the civil court. Respondents 1 and 2 are not conferred with the jurisdiction to decide as to who are the legal heirs. The petitioner, in case is so desirous, can approach the jurisdictional civil court and get a declaration that she and her siblings are the only legal heirs of the deceased Paulraj. Furthermore, Indira, not being a party to the writ petition, I cannot give a direction, as sought for in the Writ Petition.

3. Writ Petition is dismissed, with the aforesaid liberty. No costs. 22.04.2025 NCC :
