Respondents Prayer: Writ Petition is filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus directing the 2nd respondent to take appropriate action to expeditiously conclude the proceedings in Moo.Mu.A4/2989/2024 pending on the file of 2nd respondent and to pass appropriate orders in accordance with law on its own merits within the time frame to be fixed by this Court. 1/4

ORDER

The petitioner is before this Court seeking for a direction to the second respondent to issue legal heir certificate in respect of the deceased brother of the petitioner namely Sivaraj, who died on 26.03.2013.

2. Learned Standing Counsel on instructions submitted that the deceased died in Namakkal District and he was employed in Namakkal District and therefore, the second respondent has no jurisdiction to entertain the claim of the petitioner and if the petitioner submits an application before the Tahsildar, Namakkal District, the same will be considered in accordance with law.

3. The said submission is taken on record.

4. The Writ Petition is disposed of reserving liberty to the petitioner to submit an application for issuance of legal heir certificate in respect of the deceased brother before the Tahsildar, Namakkal Taluk, Namakkal 2/4

District and if such an application is submitted, the Tahsildar, Namakkal Taluk, shall consider the same on its own merits and pass appropriate orders in accordance with law within a period of three(3) months from the date of receipt of such application to be submitted by the petitioner.

5. There shall be no order as to costs.
