Petition filed under Article 246 of the Constitution of India for the issuance of Writ of Certiorarified Mandamus, calling for the records of the 3rd respondent in Na.Ka.No. A5/5090/2015 dated 13.06.2015 and quash the same as illegal and arbitrary and in consequence there of directing the 2nd respondent to give adequate police protection for the conclusion of festival in Arulmighu Muthalamman temple of Karupor Village and pass such further or other orders.

O R D E R

Perusal of the records shows that a peace committee meeting was convened on 13.06.2015, following the order passed by this court in W.P.(MD).Nos 9428 and 9311 of 2015 dated 11.06.2015, but the same was ended in vein and the Tahsildar, Manapparai Taluk/3rd respondent herein passed an order by declining the permission to conduct the temple festival of Arulmighu Muthalamman temple of Karupor Village vide proceedings in Na.Ka.No. A5/5090/2015 dated 13.06.2015. https://hcservices.ecourts.gov.in/hcservices/

2. Heard the learned counsel appearing for the petitioner, the learned appearing for the fourth respondent and the learned Government Advocate appearing for the respondents 1 to 3.

3. When the matter is taken up for hearing today, both the petitioner and the private respondent being brothers agreed that the festival of Arulmighu Muthalamman temple of Karupor Village can be concluded by their mother Rajammal.

4. Accordingly, the impugned order granted by the third respondent in Na.Ka.No.A5/5090/2015 dated 13.06.2015 is set aside and the writ petition is allowed with a direction to the second respondent to grant permission and protection for the festival of Arulmighu Muthalamman temple of Karupor Village, which may be concluded by one Rajammal, the mother of the petitioner and the fourth respondent. No Costs. Consequently, connected Miscellaneous Petitions are closed.
