O R D E R

The present writ petition has been filed seeking to quash the order passed by the third respondent herein wherein a sum of Rs.17,44,971/- has been demanded on the ground that the bills have been raised under a wrong tariff.

2.According to the learned Standing Counsel appearing for the respondents, the petitioner's case would fall under Tariff- IIB2. However, the bills have been raised under Tariff-IIB1. Due to the short levy, the present impugned demand notice has been issued.

3.Considering the fact that the petitioner was not put on notice before passing the impugned order, the same is set aside and the matter is remitted back to the file of the third respondent herein. The third respondent shall issue notice to the writ petitioner and after considering the explanation offered by the writ petitioner, the third respondent is at liberty to proceed and pass orders on merits and in accordance with law. 2/4

4.With the above said observations, the writ petition stands allowed to the extent as stated above. No costs. Consequently, connected miscellaneous petitions are closed.
