JUDGMENT
When the matter came up for hearing today, the learned counsel appearing for the appellant submitted that the matter has already been settled out of Court and hence, nothing survives for adjudication in this second appeal. Recording the said submission, this second appeal is dismissed as infructuous. No costs. Consequently, connected miscellaneous petition is also dismissed. 2.At this juncture, the learned counsel for the appellant sought for refund of Court fee. The Registry is directed to refund the Court fee as per Rules.
